Renting residential and commercial property in Serbia: contract checks, legal review and negotiation support with RICS Consulting

An apartment or premises should suit you beyond looking good in photographs. Before transferring a deposit, check the owner, contract, additional charges and whether you can use the address as intended. This costs less than resolving problems after moving in.

First check the property and the other contracting party

Request the owner’s documents, property details and the authority of the person signing the contract. Compare the address, floor area and actual condition. If a representative or subtenant is letting the premises, establish the basis on which they can do so.

For a home, discuss children, pets, furniture, the owner’s access and registration of stay in advance. For business premises, also check the permitted use, whether the intended activity is possible, signage, alterations and equipment connections.

Which terms to agree in writing

  • The rent, currency, payment arrangements and any possible price changes.
  • The deposit amount, grounds for deductions and return deadline.
  • Utility and service charges: who pays, against which bills and for which period.
  • Repairs and faults: each party’s responsibility and how costs are agreed.
  • The tenancy term, early exit, notice and handover of keys.

The government portal describes a deposit of one or two months’ rent as common practice, not a mandatory rate. The intermediary’s commission and who pays it should also be clarified in advance.

Moving in and registration are separate actions

At handover, record the condition, inventory, meter readings and existing damage. Photographs and a signed handover report help distinguish old defects from responsibility for new ones.

The host must register a foreign national’s stay within 24 hours of providing accommodation or arrival as a guest. Agree their involvement before signing. A tenancy agreement and registration of stay do not, on their own, authorise long-term residence.

The search, negotiations and document revisions affect the overall timetable; the time for a simple review is not the time for the entire housing search.
